1. Acceptance of Terms

By accessing or using CledFind ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These Terms constitute a legally binding agreement between you ("User") and the CledFind service operator.

2. Permitted Use — Consent Is Non-Negotiable

CledFind is designed exclusively for voluntary, self-directed device tracking. Permitted uses include:

• Enrolling your own personally-owned device for recovery purposes.
• Enrolling a device owned by a minor child, provided you are their legal parent or guardian and the child is informed.
• Enrolling a company-owned device, provided the employee has been given clear written notice that the device is subject to location tracking and has provided written consent.
• Enrolling a device with the device owner's explicit, informed, and freely given consent.

3. Strictly Prohibited Uses

The following uses are strictly prohibited and constitute a material breach of these Terms, may expose you to civil and criminal liability, and will result in immediate termination of your access:

• Installing or activating CledFind on any device you do not own or do not have explicit written authorization to track.
• Using CledFind to stalk, harass, monitor, surveil, intimidate, or control another person.
• Using CledFind on a device belonging to a domestic partner, ex-partner, spouse, or any individual without their freely given, informed consent.
• Using CledFind for any commercial surveillance, corporate espionage, or intelligence gathering purpose.
• Modifying, forking, or redistributing CledFind code to remove the consent mechanism or operate covertly.
• Using CledFind in any manner that violates applicable local, state, national, or international law.

4. Legal Compliance

You are solely responsible for ensuring your use of CledFind complies with all applicable laws in your jurisdiction. This includes but is not limited to:

• U.S. Computer Fraud and Abuse Act (CFAA), 18 U.S.C. § 1030
• U.S. Electronic Communications Privacy Act (ECPA), 18 U.S.C. § 2511
• EU General Data Protection Regulation (GDPR), Regulation (EU) 2016/679
• UK Computer Misuse Act 1990 and UK GDPR
• California Consumer Privacy Act (CCPA)
• All applicable domestic violence, stalking, harassment, and privacy statutes in your country or region

5. Dashboard Access & Credentials

The Owner Dashboard is protected by credentials you set. You are responsible for maintaining the confidentiality of your dashboard credentials. Do not share dashboard access with unauthorized parties. You are responsible for all activity conducted through your dashboard session.

6. Data Accuracy

CledFind provides location data on a best-effort basis. GPS accuracy depends on device hardware, environment, and browser permissions. IP-based geolocation fallback may have accuracy of several kilometers. CledFind makes no warranty regarding the precision, completeness, or timeliness of location data. Do not rely solely on CledFind data for emergency response situations — always contact law enforcement.

7. Service Availability

CledFind is provided "as is" and "as available." We make no guarantees of uptime, continuous availability, or uninterrupted background sync functionality. Browser vendors may change APIs that affect Service Worker behavior, background sync, or notification permissions at any time without notice, which may affect CledFind's background tracking capabilities.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEDFIND IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICE OPERATOR DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF CLEDFIND, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold harmless the CledFind service operator and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third party right, including any privacy, property, or intellectual property right; or (d) any claim that your use of the Service caused damage to a third party.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date at the top of this page. Continued use of the Service after any such changes shall constitute your consent to such changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first, and thereafter through binding arbitration or courts of competent jurisdiction.

13. Termination

We reserve the right to terminate or suspend access to CledFind immediately, without prior notice or liability, for any breach of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, and 12 survive termination.
